Terms of Service
These terms govern your use of ClearMyCase. By using our platform, you agree to these terms.
1. Acceptance of terms
By creating an account on ClearMyCase, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these terms, you must not use the ClearMyCase platform.
2. The service
- —ClearMyCase provides a cloud-based case management platform designed for UK ward councillors
- —Access is provided via subscription on a monthly or annual basis
- —We reserve the right to update, modify, or improve the platform at any time. We will communicate significant changes in advance
3. Account registration
- —You must provide accurate, complete information when registering your account
- —You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account
- —One account is provided per councillor office. Additional staff members may be invited to access the account by the account holder
4. Subscription and payment
Monthly plan
£99/ month
Billed monthly. Cancel with 30 days' notice.
Annual plan
£79/ month
Billed annually at £948. Best value.
- —Infrastructure costs (e.g. additional storage or processing) are billed separately at cost, with advance notice
- —Payments are processed securely by Stripe. VAT invoices are provided for each payment
- —A minimum of 30 days' cancellation notice is required
5. Data ownership
- ✓You own all data you enter into ClearMyCase — case records, resident information, notes, and files
- ✓We act as a data processor on your behalf. You remain the data controller for all resident data
- ✓On cancellation, we will provide a full export of your data in a portable format before deletion
6. Acceptable use
You agree that you will:
- ✓Use ClearMyCase only in your capacity as a UK ward councillor or authorised member of a councillor's office
You agree that you will not:
- ✕Use the platform for commercial purposes unrelated to your ward duties
- ✕Attempt to access another councillor's account or data
- ✕Use the platform for any unlawful purpose
- ✕Upload malicious code, attempt to disrupt the service, or circumvent security controls
Breach of these rules may result in immediate account suspension.
7. Service availability
- —We target 99.5% uptime and publish our status at status.clearmycase.co.uk
- —Scheduled maintenance windows will be communicated by email in advance
- —We are not liable for any losses arising from unplanned downtime or service interruptions beyond our reasonable control
8. Intellectual property
The ClearMyCase platform, including all software, design, branding, and documentation, is owned by NoonTechStudio Ltd and protected by intellectual property law.
Your data — everything you enter into the platform — remains yours. We claim no intellectual property rights over your case records, notes, or resident data.
9. Limitation of liability
To the fullest extent permitted by law:
- —We are not liable for any indirect, incidental, special, or consequential losses arising from your use of ClearMyCase
- —Our total liability to you in any 12-month period is limited to the subscription fees you paid to us during that period
Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.
10. Termination
Cancellation by you
You may cancel your subscription at any time by giving 30 days' written notice to legal@clearmycase.co.uk.
Termination by us
We may terminate your account for material breach of these terms, with 7 days' written notice where practicable.
On termination for any reason: we will provide a full data export within 7 days, and all data will be permanently deleted within 30 days of the termination date.
11. Governing law
These Terms of Service are governed by and construed in accordance with the laws of England and Wales.
Any disputes arising from or relating to these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
